What is ATF Form 1 for?
The ATF Form 1 is used by the U.S. Department of Justice to determine if ownership of a firearm meets Federal, State, and local laws. Information provided on this form is used as proof of registration of a firearm by the manufacturer. All registration data on this form will be entered into the National Firearms Registration and Transfer Record.
Is ATF 5320 Form 1 accompanied by other forms?
The completed form requires a payment of $200 tax, so payment must be attached. If ATF Form 1 is filed by 1) a producer acting on behalf of the United States, or any government department, or agency or by 2) a producer operating on behalf of any State or possession of the United States, or any police organization, the $200 fee should not be paid. The corresponding block in the Type of Application section should be checked for such cases.
When is ATF Form 1 due?
ATF 5320 Form 1 should be submitted every time a firearm is made, except when an NFA firearm is made by the United States, any State, or political subdivision thereof.
